Phoenix Power Terms of Service

1. Introduction and Acceptance of Terms

Phoenix Power: From Ashes to Action (the “Program”) is an educational and wellness-focused experience offered and operated by Amplified Pursuit, LLC (“Amplified Pursuit,” “we,” “us,” or “our”). The Program may include digital courses, educational materials, group or individual coaching, workshops, and related content and services (collectively, the “Services”). References to “Phoenix Power,” the “Program,” or the “Services” refer collectively to Phoenix Power: From Ashes to Action and any associated materials, content, or services provided by Amplified Pursuit, LLC.

The purchasers and authorized users of the Services may be referred to herein as the “Purchaser,” “User,” or “you.”

By accessing, purchasing, or using the Services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not access or use the Services.

Certain Services offered by Phoenix Power may include coaching. Coaching services are subject to a separate Coaching Addendum, which is incorporated by reference into these Terms. By purchasing or participating in coaching services, you agree to be bound by the Coaching Addendum in addition to these Terms.

Neither the Phoenix Power Program materials nor the Coaching services involve diagnosis or treatment of any mental or physical condition, nor do they constitute the practice or provision of medicine or mental health care.

2. Educational Purpose Only — No Professional Advice

The Program is provided for educational and informational purposes only.

No Medical Advice

The Services do not constitute medical advice and are not intended to diagnose, treat, cure, or prevent any physical or mental disease or medical condition. Use of the Services does not create a physician-patient, clinician-patient, or therapeutic relationship.

No Professional, Financial, Legal, or Relationship Advice

The Services do not provide:

• Medical or mental health counseling
• Professional or career advice
• Legal advice
• Financial, investment or tax advice
• Relationship or marital counseling

Coaching services offered through the Program are governed by a separate Coaching Addendum. Coaching services are non-clinical, non-therapeutic, and educational in nature, and are not a substitute for medical, mental health, legal, financial, or other professional advice.

You are encouraged to consult appropriately licensed professionals before making decisions in these areas. You acknowledge that you are not relying on any statements or representations made through the Services as a substitute for professional advice or judgment.

3. Not for Emergency or Crisis Situations

The Services are not intended for use in emergency or crisis situations. If you are experiencing suicidal thoughts, severe emotional distress, or a mental health emergency, you should seek immediate assistance from qualified professionals or emergency services. Phoenix Power does not provide crisis intervention services.

4. Intended Audience

The Program is designed specifically for physicians. While other healthcare professionals may access the Services, Phoenix Power is intentionally developed with physician responsibilities, ethical obligations, and professional identity in mind.

The Program is not designed for use by minors. Any use by or sharing with minors of the Program or Services is prohibited by these Terms.

5. Individual Responsibility and Assumption of Risk

You acknowledge and agree that:

• Your participation in the Program is voluntary
• All decisions, actions, and outcomes resulting from use of the Services are solely your responsibility
• Results vary by individual and no outcomes are guaranteed

To the fullest extent permitted by law, you assume all risks associated with your use of the Services, including risks related to physical, mental, emotional, professional, and financial well-being.

6. No Representations, Warranties or Guarantees

We make no representations, warranties or guarantees regarding any specific outcomes or results by participants using the Services, including:

• Burnout recovery
• Health outcomes
• Career satisfaction or advancement
• Financial results
• Personal or professional transformation

Testimonials, examples, or case studies are illustrative only and do not guarantee results.

7. User Accounts and Access

You agree to:

• Provide accurate and current information needed to establish User accounts and access, including a valid name and email address
• Maintain the confidentiality of your login credentials
• Use the Services for personal, non-commercial purposes only

We reserve the right to suspend or terminate access for violations of these Terms.

8. Intellectual Property

All content included in the Services — including videos, text, graphics, logos, frameworks, and materials — is the exclusive property of Amplified Pursuit, LLC and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use only.

You may not copy, reproduce, distribute, sell, sublicense, or create derivative works using the course materials used in the Program or other Services without our prior written consent.

9. Prohibited Conduct

You agree not to:

• Share or resell access to the course materials used in the Program or other Services to unauthorized individuals or entities
• Misrepresent your identity or credentials
• Use the Services for unlawful purposes
• Interfere with or disrupt the Services

Violation may result in immediate termination of the Services without refund.

10. Refunds and Money-Back Guarantee

Amplified Pursuit offers a thirty (30) day money-back guarantee for Phoenix Power: From Ashes to Action, as further described in the Refund Policy. To request a refund, you must submit a written request to [email protected] within the applicable refund period stating the reason for requesting the refund. Refunds requested after the stated period will not be granted.

Upon issuance of a refund, your access to the Program and Services will be revoked.

Refund policies may vary by product, service, or promotional offering and are incorporated by reference into these Terms.

11. Modification or Discontinuation of Services

Amplified Pursuit, LLC reserves the right to modify, update, suspend, or discontinue any aspect of the Services at any time, with or without notice. Except as expressly provided in the Refund Policy, no refunds are guaranteed for changes to content, format, or delivery.

12. Charitable Contributions

Amplified Pursuit, LLC may, at its discretion, donate a portion of program revenue to nonprofit organizations aligned with the mission of Phoenix Power.

Any such contributions are made by Amplified Pursuit, LLC as a company initiative and are not charitable donations made by program participants.

Donations, including the amount, timing, and recipient organizations, are determined solely by Amplified Pursuit, LLC and are typically calculated after applicable refund periods have concluded.

Purchases of Phoenix Power programs or services do not constitute charitable donations by Users and are not tax-deductible by purchasers.

13. Limitation of Liability

To the fullest extent permitted by law, Amplified Pursuit, LLC, Phoenix Power, and their owners, officers, agents, employees, partners, contractors, and contributors (collectively, its “Affiliates”) shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Services, including damages arising out of the negligent acts or inaction of Amplified Pursuit, LLC or its Affiliates.

This includes, without limitation, damages for loss of income, professional consequences, health outcomes, emotional distress, or personal dissatisfaction.

14. Indemnification

You agree to indemnify, defend, and hold harmless Amplified Pursuit, LLC and its owners, officers, agents, employees, partners, affiliates, and contractors from any claims, liabilities, damages, losses, or expenses arising from your use of the Services or violation of these Terms, including damages arising out of the negligent acts or inaction of Amplified Pursuit, LLC or its Affiliates.

15. Third-Party Services and Links

The Services may contain links to third-party websites or platforms. We are not responsible for their content, availability, or practices, and cannot guarantee the safety of access to these websites or resources.

16. California Residents (CCPA/CPRA)

If you are a California resident, you may have certain rights under the California Consumer Privacy Act and California Privacy Rights Act, as described in our Privacy Policy. Phoenix Power and Amplified Pursuit, LLC do not sell or share personal information as defined under these laws. 

17. European Economic Area (GDPR)

If you are located in the European Economic Area, United Kingdom, or Switzerland, and GDPR applies, your use of the Services and processing of personal data are governed as described in our Privacy Policy.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect to fullest extent permitted by law.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts having jurisdiction over claims or causes of action arising in Polk County, Wisconsin.

20. Assignment Clause

Amplified Pursuit, LLC may assign these Terms in connection with a merger, sale of assets, or corporate restructuring without notice. You may not assign your rights or obligations without our prior written consent.

21. Attorney’s Fees

Amplified Pursuit, LLC is entitled to an award of its attorneys fees and costs incurred as a result of your violation of any of these Terms or any supplemental terms and conditions, addendums, or other agreements for the provision of the Services.

22. Changes to These Terms

We reserve the right to modify these Terms at any time. Continued use of the Services constitutes acceptance of any updates.

23. Entire Agreement

These Terms, together with any incorporated policies or addenda, constitute the entire agreement between you and Amplified Pursuit, LLC regarding the Services and supersede all prior or contemporaneous discussions, negotiations or other communications.
